Timeline of the Georgia NAACP’s Legal Battle against SB 202
The Georgia NAACP has been on the front lines challenging Senate Bill 202 (SB 202), Georgia’s restrictive voting law passed in March 2021. Here’s a look at key moments in our legal fight to protect voting rights:
March 2021: Governor Brian Kemp signs SB 202 into law, introducing stricter voter ID requirements, limiting ballot drop boxes, and making it illegal to distribute food and water to voters in line.
March 2021: The Georgia NAACP files a federal lawsuit, arguing SB 202 disproportionately affects Black voters and violates the Voting Rights Act and the U.S. Constitution.
June 2021: The U.S. Department of Justice joins the legal challenge, reinforcing claims that SB 202 is discriminatory.
December 2021: A federal court denies the state’s motion to dismiss, allowing the lawsuit to move forward.
August 2022: The court refuses to block the food and water ban ahead of elections but acknowledges its potential unconstitutionality.
August 2023: A partial victory! The court blocks the rejection of absentee ballots over birthdate errors and allows limited food and water distribution at polling places.
October 2023 - January 2024: The court upholds many SB 202 provisions, including limits on absentee voting, drop boxes, and shortened runoff periods.
March 2025: Attorney General Pam Bondi directs the DOJ to withdraw from the case, but the Georgia NAACP continues the fight in its separate litigation against the State of Georgia.
